1. Our Commitment to a Safe Platform
This comprehensive policy aims to create a safe, respectful, and legally compliant environment for all Users of AllQR (https://allqr.co), including individuals, businesses, marketers, and enterprises who create, link, or distribute content through QR codes, Smart Links, and Custom QR Landing Pages on the Platform. All Users are encouraged to familiarize themselves with these guidelines and to contribute to a positive, trustworthy ecosystem around QR-based engagement.
The Platform reserves the right to update these guidelines as necessary to comply with changing laws and community needs.
2. Content We Do Not Allow
Illegal Activities: Any content, destination page, or linked material that promotes, depicts, or facilitates activities prohibited by Indian law is strictly forbidden. This includes content related to terrorism, drug trafficking, human trafficking, illegal weapons, or any other criminal activities, whether accessed directly or via a QR code, Smart Link, or landing page created through AllQR.
Hate Speech and Discrimination: Any content that promotes or incites hatred, violence, or discrimination against individuals or groups based on protected characteristics such as race, religion, caste, gender, sexual orientation, or national origin shall not be entertained on the Platform. The use of derogatory language, slurs, stereotypes, or content that promotes supremacist ideologies is completely and strictly prohibited.
Explicit Sexual Content: Any content that depicts graphic sexual acts, nudity, or pornography shall not be entertained on the Platform. The Platform strictly prohibits any content or activities related to prostitution, sex work, or the offering of sexual services. This includes, but is not limited to, solicitation, promotion of escort services, or any content that could be construed as facilitating or encouraging such activities.
The use of pornographic images, videos, or text; non-consensual intimate imagery; or sexually explicit content involving minors via any medium, comment, QR destination, or landing page is strictly prohibited. This also includes content taken from another platform, content involving a minor, content involving an animal, content promoting or showcasing cannibalism and/or necrophilia, or content used for the purposes of defamation, revenge porn, or any other unethical or moral violation.
Violence and Gore: Content featuring graphic violence, extreme gore, death, or the glorification of violent acts is not permitted. This includes real-life depictions of violence, simulated violence, or any content that could be considered excessively violent or disturbing.
Copyright Infringement: Users must respect intellectual property rights. Unauthorized use, reproduction, or distribution of copyrighted materials, including but not limited to text, images, videos, music, logos, and software, through any QR code, Smart Link, or landing page created via AllQR is strictly prohibited.
Misinformation and Fake News: The dissemination of false or deliberately misleading information, manipulated media, or unverified claims, including but not limited to fake news, conspiracy theories, or deliberately deceptive content, is prohibited. Users are required to ensure their linked content is accurate to the best of their knowledge.
3. Restricted Products & Activities
Any sale, promotion, preaching, practice, comment, or content related to the below-mentioned prohibited activities is strictly forbidden through any QR code, Smart Link, or landing page hosted or generated using AllQR. Users are responsible for ensuring that their content does not directly or indirectly promote or facilitate any of these prohibited activities.
- Alcohol and Tobacco: The sale, promotion, advertisement, or encouragement of alcohol and tobacco products is strictly prohibited on the Platform.
- Finance and Cryptocurrency: Users are prohibited from offering financial advice, promoting investment opportunities, or facilitating the sale or exchange of cryptocurrencies or other financial instruments without appropriate licenses and regulatory approvals.
- Money Laundering: Any activities that may constitute or facilitate money laundering, including disguising the origins of illegally obtained money or promoting offshore banking services, are strictly forbidden.
- Raffles and Gambling: The organization, promotion, or facilitation of any form of gambling, including raffles, lotteries, or betting activities, is prohibited on the Platform.
- Sale of Eatables or Consumable Goods: The Platform prohibits QR codes or landing pages used to sell, exchange, or promote eatables, food items, or consumable goods without appropriate licenses, where such use violates applicable law.
- Multi-Level Marketing: Any form of multi-level marketing, pyramid schemes, or chain referral systems is strictly prohibited.
- Weapons and Explosives: The sale, promotion, or instruction in the use of weapons, explosives, or other dangerous items is strictly forbidden.
- Drugs, Medications, Herbal Mixes, and Supplements: The sale, promotion, or advertisement of any drugs, medications, herbal mixes, or dietary supplements claiming medical or health benefits is prohibited.
- Preaching and Practice of Witchcraft: Content that promotes, teaches, or glorifies witchcraft or occult practices intended to cause harm to another User is not permitted on the Platform.
4. Ownership & Copyright Compliance
Respect for Copyrights and Trademarks: Users must obtain necessary permissions or licenses before using any copyrighted or trademarked material in any QR code destination, landing page, or Smart Link created via AllQR. This includes but is not limited to music, images, videos, logos, and brand names.
Fair Use Provisions: Users may use copyrighted material without permission only if it falls under the fair use doctrine as defined by Indian copyright law. This may include use for criticism, commentary, news reporting, teaching, scholarship, or research. Users are advised to seek legal counsel if unsure about the applicability of fair use.
5. Data Privacy Obligations
Compliance with the Digital Personal Data Protection Act, 2023: Users who collect personal data from visitors or scanners through their QR codes or landing pages shall adhere to all applicable provisions of the DPDPA, 2023, including but not limited to:
- Obtaining explicit consent from Users for data collection and processing.
- Implementing appropriate security measures to protect personal data.
- Providing Users with the right to access, correct, and delete their personal data.
- Appointing a Data Protection Officer to oversee compliance, where applicable.
User Consent for Data Collection and Processing: The Platform will obtain clear and informed consent from Users before collecting, processing, or sharing any personal data. Users are expected to read our Privacy Policy available on the Platform to understand how their data is collected, used, and protected.
6. Community Conduct
Respectful Communication: Users are urged to keep all interactions on the Platform free from abuse, harassment, or offensive language. Users must communicate in a civil and respectful manner in comments, support requests, and all Platform interactions.
No Harassment or Bullying Tolerated: Any behaviour that intimidates, threatens, or causes emotional distress to other Users is prohibited. Persistent unwanted contact, threats, criminal intimidation, doxxing, or coordinated attacks against other Users are strictly prohibited on the Platform.
Prohibition of Spam and Fraudulent Activities: Any unsolicited and/or bulk messages, deceptive practices, phishing attempts, scams, or false advertising aimed at misleading Users, including through malicious QR codes or deceptive Smart Links, are strictly prohibited.
7. Responsibilities of Every User
Accurate Content Descriptions: Users are obliged to provide a clear and truthful representation of the destination content linked to their QR codes before other Users engage with it. Misleading or deceptive QR code destinations are strictly prohibited.
Adherence to Platform Policies: Users are required to familiarize themselves with and comply with all Platform policies, including these guidelines and any subsequent updates.
Transparency in Sponsored Content: Clear and explicit disclosure of any commercial relationships, paid promotions, or sponsored content is expected from Users towards other Users interacting with their QR codes or landing pages.
8. Reporting a Concern
The Platform will provide easily accessible mechanisms for Users to report content or behaviour that violates these guidelines. Reports will be treated confidentially and investigated promptly.
9. Review Process & Enforcement Actions
Content Review Process: The Platform utilises a content review system, which may include both automated systems and human moderators, to ensure compliance with these guidelines. Reported or flagged content will be reviewed by trained moderators within 72 hours of submission of the request. Any content found to be in violation of these guidelines will be immediately removed or deactivated from the Platform.
Graduated Response to Violations: All reported violations of these guidelines will be thoroughly investigated by the Platform's moderation team. The severity of the violation will be assessed based on the nature of the content, the User's intent, and the potential harm caused. Violations of these guidelines will be addressed through a graduated response system:
- First offence: Warning and temporary content or QR code deactivation.
- Second offence: Temporary account suspension for 7 to 14 days (duration based on the severity of the violation).
- Third offence: Permanent account termination.
In cases of severe violations, particularly those involving illegal activities or posing immediate, bodily, or online harm to Users, the Platform reserves the right to immediately terminate the User's account and report the incident to relevant law enforcement agencies.
For Users found to be in violation of these guidelines, the Platform reserves the right to withhold any subscription refunds or credits associated with the violating content. The Platform may impose additional restrictions in cases of repeated or severe violations, as stipulated in the User's subscription agreement.
The Platform reserves the right to pursue legal action against Users who engage in illegal activities or cause significant harm to the Platform or its Users.
10. Requesting a Review of Our Decision
Users will have the right to appeal any moderation decisions. The appeal process will be clearly communicated and conducted fairly and impartially. Users can submit appeals through a designated Platform interface within 7 days of a moderation action. Appeals found to be frivolous or in bad faith may be disregarded.
Users whose accounts have been terminated may apply for reinstatement after a period of one year. Reinstatement applications will be reviewed on a case-by-case basis and are not guaranteed to be approved.
11. Keeping Your Data Secure
Data Breach Notification Protocols: In the event of a data breach, the Platform will notify affected Users and relevant authorities within the timeframe specified by the Digital Personal Data Protection Act, 2023. Users will be notified within 72 hours of a confirmed data breach affecting their personal information.
12. Openness & Communication
Regular Transparency Reports: The Platform may publish periodic transparency reports detailing content removal requests, account suspensions, and other relevant moderation activities.
Clear Communication of Policy Changes: There shall be timely and accessible notifications of updates to Platform policies and guidelines. Users will be notified of significant policy changes via email and/or in-Platform notifications at least 7 (seven) days before implementation. The Platform strives for clear communication with all Users.
13. Grievance Redressal
Redressal Mechanism:
Any complaints, abuse, or concerns with regards to content and/or comment or breach of these guidelines shall be immediately informed to the designated Grievance Officer as mentioned below via in writing or through email signed with the electronic signature to the Grievance Officer.
